Custody Provisions in Protection Orders

This teleconference will explore issues
related to inter-jurisdictional custody cases, specifically the custody
provisions in protection orders. Discussion will center around the
changes to the definition of protection orders that were enacted in VAWA
2005, how custody provisions are enforced, the inter-relationship of the
custody statutes (UCCJEA, UCCJA, PKPA, etc.), how custody provisions in
protection orders can be modified, and the duration of custody
provisions.

Full Faith and Credit – Firearms for Advocates and Attorneys (Barbara J.

This teleconference will focus on the federal firearms prohibitions
related to domestic violence and the role that state and federal
firearms laws can play in ensuring victim safety. Participants will
explore the role attorneys play in interacting with the legal system and
their clients, defenses that may be raised when firearms are at issue
and remedies available. Additional discussion on how legal authority
for gun removal may conflict with personal choices, and the critical
thinking necessary when firearms illegally possessed or owned. Practice
tips and materials will be provided.

Full Faith and Credit – Firearms for Law Enforcement (Pete Helein)
Training will explore the law enforcement role in seizing weapons, the
legal authority to do so, and how surrender is accomplished from a
procedural standpoint. On November 6th learn what a law enforcement
officer should know when encountering weapons related to domestic
violence cases. This teleconference will cover topics from surrender to
storage. Join us to learn feasible techniques that will improve
efficiency and effectiveness of law enforcement’s role in gun surrender
and storage programs.

Karan)
This teleconference will provide information on federal and state gun
prohibitions related to domestic violence and will explore the
judiciary’s role in the relinquishment of firearms. The primary focus
will be on the federal gun laws, with additional information on seizure,
storage considerations, return procedures and as well as discussing best
judicial practices.

Participants will have
an opportunity to ask questions about how the Violence Against Women Act
applies to Indian country and to learn what advocates and attorneys need
to know about tribal protection orders. This teleconference will
also touch on the role of military protection orders and ensuring victim
safety on and off base.
